Nicola Gobbo, the barrister turned police informer, had sex with a detective accused of trafficking marijuana and also represented the gangland killer who agreed to give evidence against him before backtracking.

A royal commission was told on Thursday that Ms Gobbo had a sexual relationship with Stephen Campbell, one of four detectives accused of ripping off $100,000 of marijuana at the St Kilda marina in 1999.

The commission is investigating the conduct of Victoria Police and one of their most prized informers, gangland barrister turned supergrass Nicola Gobbo, also known as Lawyer X and Informer 3838.

In 2003, before she became a police informant for the third time, Ms Gobbo represented a man charged over his alleged involvement in the sham raid to seize 13 kilograms of marijuana that he was to sell.

The man, who cannot be named and was later convicted of manslaughter over an underworld killing, agreed to give evidence against the police officers but then later refused.

He pled guilty and received a discount on his sentence as part of the agreement, the inquiry heard. However, he later had to be resentenced when he reneged on the deal.

A jury acquitted the officers – Glenn Saunders, Peter Alexander, Dave Waters and Campbell – after a County Court trial in 2005.

George Tapai, a retired Victoria Police ethical standards division detective who investigated the case, said he was not aware of the sexual relationship but if he knew about it he would have had concerns.

"I suppose under those circumstances it would cross my mind that anything could happen, it was certainly something I would report," he told the commission.

Megan Tittensor, counsel assisting the inquiry, cited evidence that Ms Gobbo was involved in a sexual relationship with Mr Campbell in the late 1990s and maintained a friendship with him in the early 2000s.

"Could you be certain, in a case where a person had a friendship or sexual relationship with a co-accused, that the lawyer was acting in the best interest of the client?," Ms Tittensor asked.

"I guess not, no," responded Mr Tapai.

Mr Tapai said he knew the reasons why the witness chose not to give evidence but said he was not aware if Ms Gobbo had played a role in him deciding not to.

The hearings continue.
