Murray Benjamin Smith, 45, from Lilyfield, pleaded guilty to common assault and sexually touching without consent after he approached a woman jogging along the Bay Run at about 5.30pm on December 1, 2018.

Smith walked up behind the woman, who noticed him lingering, and groped her on the buttocks, causing her to turn around and tell him to "f--- off".

According to police facts, another woman heard the victim's cries and yelled out "excuse me" to Smith, pointing out that a police car was parked nearby.

While this was happening, the victim took her phone from her pocket and took two photos of Smith.

He then walked towards her and tried to take her phone, saying "don't f---ing take a photo of me". During a struggle, the victim was hit in the face with the phone.

Smith then ran from the scene and the victim reported the assault to police. He was arrested five days later and agreed he was depicted in a photo from the victim's phone, but denied touching her.

On Wednesday, magistrate Margaret Quinn said what Smith did to the woman was "quite serious" as she jailed him for nine months with a non-parole period of six months.

Because he has been in custody since he was arrested, Smith will be eligible for release this month. He was also given a 12-month community corrections order and a $600 fine for common assault, and six months' imprisonment for failing to report to police, which he also pleaded guilty to.

"If you come back again the penalties will be rising," Magistrate Quinn said.

Smith responded: "You will never see me again, Your Honour."

His lawyer Omar Juweinat told Sydney's Central Local Court that Smith did not report to police at Balmain because he had a "falling out" with officers at the station.

In court documents, police detail that Smith has been on the child protection register since October 2015 after he was convicted of possessing child abuse material. He is required to present himself to police once a year until 2023 to ensure his details are up-to-date.

He failed to report to police in the month of November for three consecutive years, from 2016 to 2018.

Smith faced court after the first two failed appearances, and was sentenced to an 18-month bond in May 2018, but again failed to appear in November of that year.

"Police believe the accused presents a danger to members of the public as displayed in these offences," police said in court documents prepared shortly after Smith's arrest.

Smith, who is unemployed, said he was going to see a doctor "for the problems I'm going through".
