Dupas was charged last year with the 1997 murder of 95-year-old Kathleen Downes and was due to stand trial later this month.

Ms Downes was stabbed three times in the neck and her throat was cut in her room at the Brunswick Lodge Aged Care Facility in the early hours of December 31, 1997.

Today, prosecutors discontinued the case against Dupas over the health of key witness Andrew Fraser.

Supreme Court Justice Peter Almond said the decision did not constitute an acquittal and noted Dupas could be re-indicted on the murder charge at any time.

But he scrapped suppression orders which had prevented reporting on the case.

Mr Fraser, a former lawyer who served time in prison alongside Dupas, was the key witness in the prosecution's case but he is too unwell to give evidence and withstand cross-examination.

Dupas is serving three life sentences, never to be released, for killing three other women.

He was convicted for killing Mersina Halvagis at Fawkner Cemetery in 1997 and for the mutilation murders of Nicole Patterson in April 1999 and Margaret Maher in October 1997.

At the 2007 sentencing for the murder of Ms Halvagis, the sentencing judge described Dupas as a psychopath driven by a hatred of women.
