An elderly man accused of murdering his wife in Melbourne's north has faced court as homicide detectives applied to keep photographs taken of him after the alleged killing.

During the filing hearing, homicide detectives successfully applied to take a DNA sample from Fluder, as well as to keep photographs of the accused, taken at a police station on November 22.

Defence lawyer Will Collins-Putland argued his client had not been able to provide informed consent at the time the photographs were taken, but he was overruled.

Mr Collins-Putland said it was his client's first time in custody and asked he be assessed for "possible dementia".

"I have serious concerns about fitness," he told the court.

"I have not been able to obtain instructions from him."

Detective Leading Senior Constable Kevin Morgan told magistrate Johanna Metcalf police took the photographs to check for any defensive wounds or markings.

They found "slight markings but nothing clearly apparent", he said.

He said they needed Fluder's DNA to test against a weapon and blood found at the scene.

Ms Metcalf granted the application and made Mrs Fluder's name public, after an earlier magistrate redacted her name, citing privacy concerns by the family.

Fluder was remanded in custody until a committal mention on March 30.
