Biden Jr.

A drink driver who fatally struck a pedestrian in Adelaide's south will serve at least two and a half years in jail for his "reckless and selfish" decision to drive.

District Court Judge Jane Schammer sentenced 24-year-old Joshua Burroughs Norman to three years and two months' jail with a non-parole period of two years and six months.

She refused to suspend the sentence.

Norman pleaded guilty to aggravated dangerous driving over the crash that killed 21-year-old Adam Joseph on Black Road, at O'Halloran Hill, in December 2018.

Mr Joseph — a volunteer, coach and player with the Noarlunga United Soccer Club — was about to embark on the trip of a lifetime to the United Kingdom to work with English Premier League club Arsenal before he died.

Judge Schammer said she could not sentence Norman on uncharged acts but could take into consideration his history of drink driving.

She said a service station attendant working at a Caltex near the Victoria Hotel called police to report a man believed to be Norman for suspected drink driving on 12 occasions.

The court heard police confirmed they had received three separate reports about a man driving a white Mercedes sedan, believed to be Norman's car.

Take your family to an Adelaide Strikers match and enjoy an affordable, fun and entertaining night out during the school holidays.

But Judge Schammer said she could only find, beyond a reasonable doubt, Norman had been drink driving on one prior occasion — about two months before the fatal crash.

"It's not the first time you have driven home drunk," she said.

"Your decision to drive that night was reckless and selfish.

"It's likely the collision occurred because, in your intoxicated state, you did not see him."

Judge Schammer said Norman was working as a landscaper at Burnside Council at the time and if he could afford a night out with his friends, he could afford a taxi home.

She said Norman was remorseful, had no criminal history, was unlikely to reoffend and was binge drinking to cope with the fact his father was dying.

But she said the offending was serious and a jail term was needed.

'He deserves jail', victim's father says

Outside court, the victim's father David Joseph said they expected nothing less than a jail sentence.

"This has been another drink driving case between a good and a bad decision," he said.

"Adam made a good decision to walk and call an Uber after a night out drinking. Joshua Norman made a bad decision to drink and drive and he killed my son.

"On the 18th of November, Mr Norman spoke to the media and stated, 'I hope someday they will be able to get through this and be back to what they were like before'.

"If he thinks that, he deserves jail."

He thanked prosecutors and his son's friends whose "support will always be remembered".
