A public servant who fled the country during his first trial has been found guilty of raping a colleague after being brought back to Australia to face the charges.

Canberra man Haider Ali, 38, fled to Pakistan before the jury had delivered its verdict in his first trial in the ACT Supreme Court.

He was later discovered living in the United Kingdom, and was extradited back to Australia two years later, facing three charges including rape and committing acts of indecency on the woman.

The court heard the pair ran into each other at Canberra night spot Mooseheads in October 2016 before ending up back at the victim's friend's house.

The victim said Ali had come into the room where she was sleeping and assaulted her.

Ali maintained the woman had crawled into his bed and nothing had happened.

But prosecutor Anna Jameison-Williams told the jury his remarks to the woman showed he knew she was not consenting.

"He said to her no-one needs to know," she said.

Ali denied finding the woman attractive, and said he was only trying to look out for her at the bar, where people were crowding in on her.

But Ms Jamieson-Williams said Facebook messages he sent to her suggested otherwise.

"In my submission he was keen to remain in her company," she said.

Ali apologised to victim in message

The court heard his account of how things unfolded when they got to the house was also problematic, with Ali saying he was told to sleep in the bedroom.

But both women refuted that.

Ali had also sent the woman a message after the incident apologising.

"You may think if nothing happened there would be no reason to apologise so unequivocally," Ms Jamieson Williams said.

"The reason he sent that message is that he knew exactly what he did to her and he knew that it was wrong."

Ali's lawyer Richard Thomas questioned the woman's version of events, pointing to a telephone call the victim received when she was being molested.

"What she wants you to accept is that she is lying in the bed with someone she only knows as a work colleague, he's on top of her touching breasts, putting his hand inside her and trying to pull down her pants while she's on the phone," he said.

"There's no attempt to get the friend to call the police."

He urged the jury to accept the suggestion that Ali had been concerned about the victim, and that he was telling the truth that she got into his bed and nothing happened.

The first jury acquitted Ali of one act of indecency, but could not reach a verdict on the other charges.

But today another jury found him guilty of all three charges.

Ali will be sentenced next month.

He has pleaded guilty to failing to appear at his 2017 trial, but the matter is still being considered in the ACT Magistrates Court.

Ali will be back in court for that matter later this week.
