The Australian Securities and Investments Commission (ASIC) launched legal action in December to shut down Maxi EFX Global (which trades as EuropeFX) and two associated companies, BrightAU Capital (which trades as TradeFred) and Union Standard International Group (also known as USG), following concerns the entities were involved in illegal online trading schemes.

Australian and international customers are estimated by the corporate watchdog to have poured close to $100 million into the companies, court documents obtained by The Age and The Sydney Morning Herald show. Some of that money has already been transferred into bank accounts offshore, ASIC alleges. The Federal Court put freezing orders over the companies late last year.

An affidavit filed by ASIC senior manager markets enforcement Nicholas Klooger states that regulator suspects EuropeFX and the other entities "systematically engaged in dishonest and unfair conduct in the course of carrying on its financial services business in Australia, including by preventing customers from withdrawing monies from their accounts."

Court documents also show ASIC has received 64 complaints about EuropeFX, USG and TradeFred since August 2018, a further 85 complaints have been made to the Australian Financial Complaints Authority.

According to ASIC, customers complained the representatives from the companies gave instructions "as to exactly which trades to make and how to trade" and the "utilisation of high-pressure sales tactics to induce customers into trading and depositing more, including borrowing money".

It is alleged customers were called daily by representatives to top up bets on commodity price movements and foreign exchange fluctuations. Some customers were promised bonus credits of $5000 if they put in $5000, yet those bonuses were allegedly never received by the customers. It alleges the companies are suspected of several breaches of the Corporations Act including sections that are criminal offences, such as misleading and deceptive conduct rising to a criminal level.

Along with customers being unable to withdraw money they put into the trading platforms, ASIC alleges they were prevented from using a common loss technique called a stop loss.

EuropeFX, TradeFred and USG have also been accused by ASIC of facilitating breaches of Chinese law by customers based in China. Chinese authorities are also investigating.

The Rabbitohs announced EuropeFX as the club's "official foreign exchange partner" in July when the company was already under investigation by ASIC for serious breaches of the Corporations Act.

The Rabbitohs has not divulged the value of its sponsorship agreement with EuropeFX. The Rabbitohs has ignored repeated requests for comment including any information about any supporters have complained to the club about the EuropeFX service.

A spokesman for iSignthis said the company relied on ASIC which had granted USG an Australian Financial Services Licence. Maxi EFX Global and BrightAU Capital operate under USG's licence.

Isignthis is currently subject to reviews by ASIC and the ASX.

iSignthis' shares have been suspended from trading on the ASX since October amid concerns about the group's disclosures and the calibre of its clients.

Late last year, iSignthis took the unusual step of suing the ASX in the Federal Court alleging the market operator has unfairly kept its shares suspended and had leaked confidential information that was provided by iSignthis in response to an official request for information by the operator.
