Mark Stephens revealed Jonathan Sacoolas is not on the official diplomatic list, meaning he or any dependants may not be allowed protection through diplomatic immunity.

The international lawyer said the Foreign Office has confirmed this to him. Sky News is waiting for confirmation from the Foreign Office.

Mr Sacoolas' wife, Anne, was granted diplomatic immunity and flew to the US soon after British teenager Harry Dunn was killed in a car crash she is believed to have been involved in.

Police believe Mrs Sacoolas, 42, pulled out on to the wrong side of the road as she emerged from Northamptonshire's RAF Croughton on 27 August.

Last weekend Sky News was informed diplomatic immunity was extended to diplomats and their dependants outside London as part of a special agreement dating back to 1994. However this appears to now not be the case.

Mrs Sacoolas was actually given protection under a bilateral UK-US agreement which allows US spies to work from the UK and spy for the US without fear of prosecution.

Lawyers told Sky News if Mrs Sacoolas was not entitled to diplomatic immunity it might be possible for the Dunn family to sue her.

They also said it should be easier to bring her back and Boris Johnson was mistaken referring to diplomatic immunity yesterday, amongst other implications.

And, they said if she is not covered by diplomatic immunity she can be extradited to the UK if she goes anywhere but the US.

The US Embassy told Sky News it "has nothing at this time" when asked for a comment.

Harry's parents told Sky News on Monday they want Mrs Sacoolas to return to the UK to talk to them face-to-face to apologise.
