The Countdown for Obstruction of Justice: A Look at the Case Against Former Obama Officials
Gregg Jarrett, a legal analyst with Fox News, stated over the weekend that a potential legal action against former Obama intelligence officials for obstruction of justice began as soon as certain evidence was uncovered by the Trump administration. This points towards a broader criminal conspiracy potentially involved in the matter.
This situation reignited scrutiny of the Russia investigation, which claimed that Donald Trump’s 2016 campaign was actually working with Russia to influence the election’s outcome. Newly emerged insights in July confirmed that the FBI placed former high-profile officials, such as James Comey and John Brennan, under criminal investigation.
Host Maria Bartiromo of ‘Sunday Morning Futures’ prompted Jarrett with a significant question about whether the Department of Justice would take action and if conspiracy law regulations apply here.

Jarrett responded affirmatively, saying, “This indeed resembles a wide-reaching criminal conspiracy carried out by people behaving dishonestly. It encompasses conspiracy to perpetuate fraud against the government, violations of legal rights, and significantly—I must stress this—obstruction of justice along with a thorough cover-up.” He noted, “As indicated by Stephen Miller, this complex cover-up has spanned years, complicating the statute of limitations in any conspiracy-related cases. The countdown resumes once previously hidden evidence surfaces, which has recently occurred.”
He provided an example, talking about the recently unearthed ‘burn bags’ containing incriminating documents at the FBI, as well as other locked-away hard drives reportedly belonging to Comey. “Fiddling with evidence tied to investigations is obstruction. This means that every time there’s an overt act in the conspiracy, it resets the statute’s clock. That’s where a conspiracy lawsuit with an obstruction aspect becomes crucial.”
The digital arm of Fox News kicked off the story on July 8 about the investigations into Brennan and Comey concerning misconduct regarding the much-maligned Steele dossier.

Following recent reports, CIA Director John Ratcliffe made public an evaluation called “lessons learned” regarding the formulation of the 2017 Intelligence Community Assessment (ICA). This insight showcased Brennan pushing for the inclusion of the debunked Steele dossier in the review, despite prior warnings.
Meanwhile, DNI Tulsi Gabbard previously released documents related to the Russia inquiry on July 18, bringing to light how Obama’s previous intelligence heads might have leveraged the Russia case against Trump during his first term.
Bartiromo then inquired about potential timelines regarding when the DOJ might initiate actions against these former officials.

Jarrett emphasized that they likely need more corroborative evidence, much of which could be quite damning. However, he advised, “Don’t get paranoid about the clock; focus instead on gathering reliable evidence that’s credible enough for a grand jury.”
Moreover, a Wednesday report highlighted findings from FBI Director Kash Patel, revealing that ‘burn bags’ held thousands of papers aimed at delegitimizing the Russia narrative. According to Fox News, one of the materials retrieved included a highly sensitive document relevant to special counsel John Durham’s conclusive report, hinting at evidence of the FBI’s role in promoting the Russia collusion storyline.
