U. S . Attorney Robert Hur is recommending a nearly five-year prison sentence for former Baltimore mayor Catherine Pugh in the "Healthy Holly" scandal.

Former Baltimore Mayor Catherine Pugh will be sentenced Feb. 27 after she pleaded guilty Thursday to conspiracy and tax evasion.

Pugh faces prison time. Her lawyers and prosecutors agree on an amount of up to five years, but the judge can do what she pleases. Legal experts expect whatever prison time she gets will be served at a federal camp.

"That's not binding on the judge. The judge takes a whole bunch of other things into account that serves as a starting point for the judge's consideration," said Robert Hur, U.S. attorney for Maryland.

"They are going to get medical records. They are going to get into her education. They are going to get into her finances. That's a big deal in this case because there are issues about her assets," said Andrew Alperstein, an attorney who is not associated with the Pugh case.

As a condition of her release, Pugh agreed to pay what she owes the Internal Revenue Service for tax years 2013 through 2017. That figure is said to be more than $100,000.

"If she doesn't pay it, the government has the ability to go to her house and seize it. They could seize it now or put a lien on it because she sells it," Alperstein said.

The federal government is also seeking to seize hundreds of thousands of dollars in profits from Pugh's "Healthy Holly" book sales, which she admits were fraudulent.

"We all know about this particular scheme, but it is not the whole life of a person. The judge is charged with considering the entire background and character of the person and not just the facts," Alperstein said.

The pre-sentence report will contain facts about Pugh's career as a public servant. The prosecution, defense and Pugh will have input in the report.

"(They) can make arguments both ways," Alperstein said. "Ultimately, the judge is going to consider the background and character of the defendant."

Pugh turns 70 next week. Her age will be taken into consideration, as well as her behavior from entering her plea until sentencing. She can't travel outside the U.S., nor can she contact anyone named in the case against her.
