A West Virginia judge has made a significant decision by reversing the state’s ban on religious vaccine exemptions. This means that kids who belong to families claiming religious reasons can now go to school and take part in sports activities.
The turning point in this case came when Miranda Guzman, a plaintiff and mother, took action after the local superintendent withdrew her child’s vaccination exemption. Her lawsuit was recognized as a class action, which affects around 570 families.
Judge Michael Froble of the Raleigh County Circuit stated that the ban on religious exemptions contradicted the 2023 Equal Protection for Religion Act.
Froble concluded, “Legislative intent isn’t the absolute determinant in gauging a statute or its implementation; at best, it’s merely a consideration.”
Following the judge’s ruling, West Virginia Governor Patrick Morrisey described it as “a victory for every family impacted who sought to remain true to their beliefs while navigating the school system.”
