A security firm which was this week ordered to pay a record €52,000 to an ex-worker who was sacked for having a baby has done it before, the Irish Mirror can reveal.

On Thursday distraught mum Karen Kelly, 32, told how she lost her home after her receptionist’s job was given to a male employee while she was on maternity leave.

She received more than €52,000 for discriminatory dismissal – the maximum award the Labour Court can make for a case of that kind.

In another ruling three years ago with striking similarities, an award of €12,000 was given against G4S in January 2016 by the Employment Appeals Tribunal.

The EAT found in favour of a new mum who claimed constructive dismissal after her €483-a-week job was given to someone else while she was on maternity leave.

The woman worked as a full-time receptionist for three years but claimed she was given no choice but to leave when she tried to return to work in 2013.

She gave evidence that when she arrived back to work on the agreed date at a building in Dublin’s IFSC she found a colleague had taken her position.

He told her he was now working there full-time and that she should contact HR – and when she did she was told to “go home and they would be in touch”.

At a follow-up meeting she was told she was being sent to a site 10km from the city centre to work night shifts – despite having a young baby to look after.

The woman said since she could not work those shifts at that location, which meant she was not being paid, she had no alternative but to look for another job.

The Tribunal ruled the woman’s decision to quit was reasonable because parts of the Maternity Protection Act were not implemented.

She received €12,000 under the Unfair Dismissals Act.

Earlier this week Ms Kelly told how she was also expected to take up a different job when she returned from having a baby.

Despite receiving €52,152 she said the money could not make up for what her former employers put her through.

She said: “We couldn’t pay the rent, we lost our home, it all began to deteriorate.

“I was good at my job, I loved my job, my job was like a home from home. I loved the people and everything about it.

“I never got an apology or one ounce of them saying they were sorry for what happened to me.

“We are in 2019, who gets sacked because you have a baby. I feel like I’ve done justice for women and mothers.”

Karen’s solicitor Mairead Carey of Carey Solicitors said: "It’s a lesson to employers. The court said any award has to be a deterrent."

The Irish Mirror has contacted G4S for a comment.
