Michael Noyek, 68, will only go out walking under cover of darkness after a judge described him as “grossly overweight” in open court.

Judge James O’Donoghue halved Mr Noyek’s damages claim at Dublin Circuit Civil Court because he said he had made no attempt to exercise or rehabilitate himself.

Michael told the Irish Sunday Mirror: “I had a bombshell of a day in court. I was very hurt by the whole thing. He doesn’t know my circumstances.

Michael, from Clonee in West Dublin, was awarded just over €22,000 of his €44,835 claim after he underwent surgery on a tear to his right shoulder following a car crash.

The court heard he suffered whiplash injuries to his shoulder and neck after a car rear-ended his vehicle while he was stopped at traffic lights in Blanchardstown in 2012.

Retired driving instructor Michael said: “The case dragged on for seven years. After fees I got €13,500 and my operation cost €3,000.

“Was it worth it? No, not for the way I was spoken to. It’s affected my confidence. I don’t want to go out, I don’t leave the house.

“I was shocked and mortified by the whole thing. I got no chance to say anything in court. I felt I wanted the ground to open up and swallow me.”

Ironically Michael, who worked as a driving instructor for 32 years, had taught the motorist behind the wheel of the car in the crash how to drive.

She had claimed his car rolled back and collided with her vehicle, but Judge O’Donoghue said he believed Mr Noyek’s version of events.

Michael said his day in court has had a devastating effect on him and he is now afraid to go out in public.

He added: “I walk by night now to avoid being seen. Nobody else has ever hurt my feelings like that.

“I’d love to meet that judge face to face and tell him what I think. A judge is in a position of great authority and power – he should think before he speaks.”
