How Mason Saldana died, though, remains under investigation.

A tourist from Oklahoma found Saldana on Aug. 5 last year, with just a diaper on.

His father, James Currie, was picked up in Thailand soon after and brought back to the U.S. where he was charged with concealment of a human corpse.

It was unclear whether Friday's ruling portended more charges for Currie.

Prosecutors previous announced that Currie sent threatening text messages to the child's mother such as "You will never see Mason again."
