A lawyer for NYPD Officer Daniel Pantaleo had argued that the Civilian Complaint Review Board does not have the jurisdiction to prosecute him in the trial room at One Police Plaza because the complaint against Pantaleo was filed by a woman who didn’t witness what happened July 17, 2014, when Garner died after he was forced to the ground by several cops.

NEW YORK (1010 WINS) -- It's been five years since the death of Eric Garner on Staten Island.

Monday began a disciplinary trial for Officer Daniel Pantaleo put Garner in an apparent chokehold when he resisted arrest for selling loose cigarettes.

    Disciplinary Trial Today For Officer In Eric Garner’s Death, ‘I Can’t Breathe’ Case It's been nearly five years since Eric Garner's death, and now a long awaited disciplinary trial will begin to learn whether Officer Daniel Pantaleo will keep his position with the NYPD for his involvement. Pantaleo is being prosecuted by the civilian complaint review board, reports CBS2’s Jenna DeAngelis. Pantaleo's lawyer Stuart London said it's a misconception that Garner complained while the officer's hands were around his neck. He said that happened while they were trying to handcuff him.

London claims his client used an approved technique during the arrest.

"Did not use a chokehold but a neckhold, an approved method ... it's called a seat belt technique. The purpose is to take the individual down," he said.

He also argued that Garner's own health played a role in his death.

"Died from being morbidly obese ... coupled with chronic asthma. He was a ticking time bomb who set these factors in motion by resisting arrest," he said.

Garner's mother Gwenn Carr says there's more to it than that.

"There were officers who pounced on my son as he laid on the ground and said 'I can't breathe' 11 times, there were officers who looked the other way, and still there were other officers who lied on official reports," Carr said.

London said there's no way Garner could have been choked out because he was able to speak, and said his client feared for his life while doing his job.

"The only one that did their job that day, I will submit, is officer Pantaleo," he said.

He said Pantaleo worried Garner might push him into a plate glass window.

The man who recorded the incident, Ramsey Ora, testified and the video was played during Monday's hearing.

If convicted, Pantaleo could face anything from a loss of vacation to dismissal from the NYPD.

Protestors made their presence felt outside of the courtroom on Monday, unfurling a massive banner across the FDR, and condemning Pantaleo.
