The driver accused of causing the deadly – 22-year-old Dylan Etheridge – crash pleaded not guilty in East Boston Municipal court on several charges, including motor vehicle homicide and leaving the scene of an accident. Police say he was speeding in a Mazda that hit a curb, rolled over and crashed on Bennington Street early Sunday morning near the Orient Heights MBTA station. The Mazda hit several parked cars and a cement planter in the median before ending up on its roof.

Gloria Bartek, 77, drove straight through a church parking lot and busy road before hitting and killing 8-year-old Khloe Nida, who was bringing milk to her grandparents.

Bartek pleaded no contest to the misdemeanor charge of negligent vehicular homicide.

The sentence, delivered Monday, mandates Bartek serve three days in jail every year for five years, on the anniversary of Khloe’s death, the Berea Municipal Court confirmed to The News.

Additionally, Bartek’s license is suspended for five years, and the judge tacked on a $500 fine, plus probation. At most, she faced six months jail time and a $1,000 fine.

Judge Mark Comstock said he took all sides of the case into consideration.

The circumstances surrounding the case remain baffling as Bartek’s car had no mechanical issues and she had reportedly never gotten a ticket before.

Bartek flummoxed the court when she didn’t apologize, even after claiming, “I understand what the family’s going through.”

Her lawyer refused to let her tell a local Fox I-Team how the accident happened or explain the decision not to apologize.

Police footage, just released to the Fox station, shows authorities arriving to the scene as witnesses directed them to Khloe. A firetruck and ambulance headed to the scene as well.

Khloe’s family is represented by lawyer W. Craig Bashein in their pursuit of a civil lawsuit, which he said will give them the “right to question and cross examine the defendant … and get some answers.”

Speaking to The News, Bashein called Bartek’s lack of remorse and accountability “incomprehensible” and “striking.”

“There’s a number of issues that don’t make sense,” Bashein said, citing Bartek’s odd decisions: to not use the brakes as her car neared Khloe, to “[steer] toward a family and a group of people,” and then never even honking to warn Khloe.

The Brook Park Police did not immediately respond to requests for comment.
