Two girls likely peeled back a very small area of fencing surrounding a swimming pool that they nearly drowned in at a Ramapo home on Monday, police said.

The girls, ages 2 and 3, were pulled from the water by a relative at the house at 2 Sydell Lane, Ramapo police said.

Detective Lt. Michael Colbath said this morning that the girls, who are family friends, appeared to have gotten through "hard plastic construction-type" fencing that surrounded about 6 to 12 feet behind a slide near the in-ground pool in the backyard.

The homeowner faces a violation for not properly securing the pool area with a gate, according to Ramapo records.

One of the girls was already out of the hospital this morning, he said, and the other one could be released today.

The girls were taken to Westchester Medical Center after they were rescued from the pool and revived around 12:30 p.m. Monday. Police are still investigating, Colbath said.

First responders arrived on Monday and found a man performing CPR after the girls were pulled from the pool without pulses, said Neil Dahan, chief of the Spring Hill Community Volunteer Ambulance Corps. The girls regained pulses before they were taken to the hospital in Valhalla.

Ramapo's building inspector also responded on Monday and found three violations at the house, which has a history of code violations, town records show.

In addition to not having a gate to properly form a barrier around the pool, the homeowner was also illegally using the house's basement for two bedrooms, even though it does not have a high enough ceiling, emergency escape or rescue openings, according to a complaint the town filed on Monday.

The homeowner was also hit with violations in 2003 and 2010 for not maintaining a proper enclosure around the pool and illegally using a pool cabana as an apartment, according to town records.

The homeowner also faces a lawsuit in a separate matter. A woman who lives near the Sydell Lane home is suing the homeowner in Rockland County Court amid accusations that the homeowner's dog attacked her.
