VIERA —  Jose Aguiar was released on bond Friday, after his arrest earlier this month on racketeering allegations.

Circuit Court Judge Jeffrey Mahl set Aguiar's bond at $30,000 for each of two felony counts. To bond out of jail, Aguiar had to put up at least 10% — $6,000 —  of the $60,000.

Aguiar, who briefly ran for Palm Bay City Council in 2016, faces charges of racketeering and conspiracy to commit racketeering in Palm Bay.

Aguiar was arrested May 10, along with former Palm Bay Deputy City Manager Dave Isnardi.

The arrest affidavits describe scenarios in which the two conspired to bribe and/or blackmail city councilmen to vote for zoning changes that would benefit them financially in the future.

The arrest documents allege Isnardi and Aguiar were plotting to use a hidden camera to record then-City Councilman Trey Holton and current Councilman Jeff Bailey having sex with prostitutes at “the Clubhouse,” a Canova Street home then owned by Aguiar, where city officials hung out. They planned to use those recordings to blackmail Holton and Bailey into, among other things, voting the way Aguiar wanted on rezoning a property he owned to allow him to open a scrap metal business that Isnardi would be a partner in.

Aguiar's attorney, Daniel Martinez, recently filed a written not guilty plea for his client.

In front of the judge Friday, wearing a neck brace and blue shirt, Aguiar stood almost motionless. He answered a litany of questions from Martinez and the prosecutor in short phrases, to reassure he is not a flight risk.

"I had an operation," Aguiar said, referring to a neck operation he said he had about six weeks ago. Martinez said after the hearing that the neck injury was the result of a car accident.

Martinez assured the court his client is not a flight risk, because of his family ties and property ownership in the community.

Nonetheless, Judge Mahl doubled the amount set forth by an by an administrative order by the chief judge of the 18th Judicial Circuit. Going by that schedule, Aguiar's bond would have been $15,000 for each of the two felonies he faces.

More than two decades ago in Massachusetts, Aguiar was convicted of conspiracy to sell cocaine and was sentenced to three years and one month in federal prison.

The FBI and Florida Department of Law Enforcement have been investigating allegations of corruption and undue influence by Aguiar and Isnardi on Palm Bay city officials since at least 2015, according to the arrest affidavits.

The arrest warrants draw heavily from secret recordings made by a confidential source working with investigators.

Although not arrested or charged, the warrants allege City Councilman Jeff Bailey had an addiction to oxycodone and former Councilman Tres Holton regularly had sex with prostitutes and used cocaine.

The arrest affidavits also allege Holton had obtained prostitutes for Mayor William Capote while the men were in Tallahassee. Capote has denied the allegations, and Holton has declined comment.

Former Palm Bay Deputy City Manager David Isnardi said having the Florida Department of Law Enforcement and the FBI looking into operations in Palm Judge Kelly Ingram denied bond to Dave Isnardi and Jose Aguiar Saturday morning because of the seriousness of the allegations against them.

Dave Isnardi is charged with two first-degree felonies, which each carry potential penalties of 30 years in prison; and three third-degree felonies, each of which carry a potential five-year prison sentence.

On May 17, Judge Morgan Laur Reinman set bond at $36,000 for Dave Isnardi and he was released from custody several hours later.

Isnardi is the husband of Brevard County Commission Chair Kristine Isnardi.

He was initially represented through the bond procedures by Bryan Lober, an attorney who also is the County Commission vice chair.

Lober has said he sees no conflict of interest in representing Isnardi, and that he took on the case because he thought he could prioritize the case and get Isnardi bonded out quicker than other attorneys might be able to.
