"It's so heartbreaking," said Her's older brother Kong Her. "My parents are going to be the ones burying him, when it should be the other way around."
Morales said Her, 27, was a two-year veteran of the department.
Her was killed when the speeding driver, who police believe was James, ran a red light and hit Her's car, Morales said.
According to the criminal complaint, James had been fired from his job several hours before the crash for showing up to work drunk. The complaint also said before the deadly crash, James had two drinks and a shot before being kicked out of a bar.
According to prosecutors, James' blood alcohol level after the crash was .209, more than twice the legal driving limit.
"He understands the charges," said Russel Jones, James' attorney. "He's ready to confront them and deal with them in court."
