McEwan spent the next 15 years of his life in prison for his role in the shooting that left 65-year-old landlord Roger Burrow dead and injured two others. He was released from state custody in October.

Last month, witnesses said McEwan, now 30, shot a man repeatedly as they struggled over the man's gun in the parking lot of a West Palm Beach-area apartment complex.

The sheriff's office did not immediately respond to questions regarding the circumstances of McEwan's arrest.

The confrontation early July 16 began when McEwan allegedly used his key to enter a woman's home on Haverhill Commons Circle, off Haverhill Road north of Belvedere Road. The woman told authorities she had been sexually involved with McEwan several times, which is why he had a key to her place, but stressed that they had not spoken in weeks.

It was about 3 a.m. and the woman was asleep in bed with her longtime boyfriend. The woman told deputies she told the man she knew as "Slim" to get out and their argument carried into the parking lot.

The 23-year-old man told The Palm Beach Post that he heard McEwan, whom he did not know, and his girlfriend yelling. When he made it outside, McEwan attacked him, the man said.

The man, who asked not to be named, said that during the fight, McEwan tried to pick him up and felt a gun in the man's pocket.

He told his girlfriend to grab the gun because he didn't want McEwan to think he would shoot.

She took the gun and backed away, records state. McEwan then went after her and her boyfriend ran to help. The men were struggling over the gun when it fired the first time.

The man said he focused on taking the gun away from McEwan. He man was shot again but still managed to wrestle it away. He threw the gun and yelled for help.

"I wasn't going out no crazy way like that," he told The Post on Tuesday.

The man was shot in the shoulder and torso. Deputies found three shell casings in the parking lot.

He said he spent two days at St. Mary's Medical Center but quickly returned to work as a laborer in a warehouse.

After the gunfire, McEwan fled in a white four-door car. Records indicate that about 30 minutes before the shooting, a West Palm Beach police officer pulled him over in that car for having an expired tag. He was wearing the same outfit that the man and his girlfriend had described to deputies.

At the time of the July shooting, McEwan was out on bond on charges from January in which a traffic stop turned into a violent confrontation with West Palm Beach officers. One officer broke a hand, and McEwan was arrested on drug and evidence-tampering charges.

That case remains open.

Saunders, McEwan's co-defendant in the 2006 killing, is serving a 50-year sentence for fatally shooting Burrow outside a West Palm Beach apartment complex that the 65-year-old owned.

Records indicate that Saunders and McEwan tried to rob a woman who was standing outside the complex. Burrow, who was installing a toilet in one of the apartments, ran outside. He and two other men were shot, as was Burrow's German shepherd, Roxie.

Burrow drove off with his dog but crashed nearby and died instantly, authorities said.

Calls to numbers listed as McEwan's were unanswered Tuesday.
