The investigation, which started one week ago, is nearing an end point. We've learned it will be up to the Hamilton County prosecutor to determine if his injuries were the result of anything criminal.

There is no confusion about what happened in the back lot at Moeller around 5:40 p.m. Wednesday.

A student was seriously hurt after jumping onto the driver's side running board of a moving Nissan Pathfinder. The unknown involves how it happened. Was it a matter of horsing around or something more than that?

According to sheriff's investigators, about 50 feet after the student climbed onto the running board he was thrown off. Right after it happened, a 911 caller told a dispatcher, "He's making noises and his eyes are fixed. They're not blinking at all."

A trainer and a nurse were at the scene quickly, and the student was flown by AirCare to U. C. Medical Center.

Investigators have examined surveillance video to try to determine the actions of each student there at the time. We are told there are key interviews they are still trying to conduct.

What witnesses saw, what the security video shows, and what the interviews reveal will all be given to Prosecutor Joe Deters as soon as the final report is ready.

He will determine if the grand jury should take a look to see if the findings meet the criteria for a criminal charge.
