Brophy McGee, a Republican from Phoenix who chairs the Senate Health and Human Services Committee, said she had been harassed by members of a group that were part of Farnsworth's biweekly gatherings.

She told police Farnsworth was inciting them to go after her. Brophy McGee said she was not threatening him but trying to convey her husband's mounting concerns for her safety.

Farnsworth, R-Mesa, took it differently. He told the Department of Public Safety he was worried Brophy McGee's comment might have been a threat against him.

“My complaint needs to be on paper and if I died — if I were murdered, I think that should be on paper that the threat was made,” he told police in an interview that included three detectives and a sergeant.

Investigators met with the County Attorney's Office and questioned both senators, Brophy McGee's husband as well as senior legislative staff who witnessed the exchange and determined her comment did not rise to the level of a criminal threat, according to police records obtained by The Arizona Republic.

"It was a baseless and meritless allegation. I think that's been proven," Brophy McGee said Wednesday. "Unfortunately, it also created an unsafe working environment for staff, for me and for others."

Farnsworth told police he would pursue charges if their investigation led to a criminal case — unless she apologized or offered some sort of clarification.

The senator said Wednesday he accepted the investigation's findings, but Farnsworth and Brophy McGee had not spoken about the episode as of Wednesday.

"I'm hoping we can work together," said Farnsworth, who is running for the Arizona Corporation Commission as he enters the last regular legislative session of his term in January.

No proof, but Farnsworth convinced of wrongdoing in foster care system

Farnsworth described the episode as a distraction from what he said is his top priority — understanding what happened to children he believes have disappeared from foster care.

In an interview with The Republic in October, Farnsworth said he had no proof children in foster care are being abducted by a worldwide trafficking network and sold into sexual slavery.

However, Farnsworth told police he is "convinced there’s very evil people out there that are stealing children from the state of Arizona," according to transcripts of interviews obtained by The Republic.

Brophy McGee, who sits on the Arizona Human Trafficking Council, told police she had tried to help Farnsworth better understand the issue, such as by referring him to law enforcement, judges and social service organizations that work on such cases.

But Farnsworth's view caught on, even getting attention in The Epoch Times, a newspaper and website known for publishing conspiracy theories.

Brophy McGee told police Farnsworth's meetings with critics of the child welfare system turned into platforms for misinformation. She described some attendees as unbalanced and unhinged, targeting her as well as state government staff and raising concerns from her husband.

The meeting that led to the complaint

Farnsworth and McGee met Oct. 1 with Senate Chief of Staff Wendy Baldo and Deputy Chief of Staff Melissa Taylor to discuss the issue.

The two senate employees told police Brophy McGee recounted concerns about harassment by people attending Farnsworth's meetings.

Brophy McGee told Farnsworth her husband was worried, Taylor told police.

"He said for me to tell you that he’s very, very concerned," Brophy McGee told Farnsworth as they sat in an office at the Senate.

Farnsworth took it as a threat and later called it the second-most aggressive threat he had ever received.

The meeting proceeded for several more minutes, though.

No one else interviewed during the investigation described it as a threat. Some perceived it as an odd comment but not a threat as much as an effort by Brophy McGee to relate to Farnsworth.

"You're dealing with an East Valley Mormon male. Let him know your husband's concerned," Brophy McGee told police in explaining how her husband suggested she approach the situation.
