Solis did not attend the probable cause hearing Sunday morning, where a magistrate judge granted a request from prosecutors to deny bail.

“This offense was committed in a cold cowardly manner, where the defendant shot [Brewster] without provocation of any kind,” senior prosecutor Jim Leitner wrote in a motion. “The officer was shot without warning before he could even touch his own weapon.”

Prosecutors told the judge that Solis’ girlfriend called police Saturday evening to report that he had assaulted her and that he had two firearms. Brewster arrived soon after.

The woman, who was walking behind Solis, called out “that’s who you are looking for,” and pointed at Solis, according to the statement prosecutors read at the hearing.

Brewster called out to Solis, who, “unprovoked raised a handgun with his right hand and fired at him multiple times,” according to the statement.

Authorities have charged one man with capital murder in the 2016 shooting of a security guard at a Harris County game room. Police heard that Thompson might have been involved in the robbery when Thompson’s mother called a family friend, who was an officer, the prosecutor said.

Brewster did not have his weapon drawn, and “was simply trying to get the defendant’s attention,” prosecutors said. Brewster fell to the ground, but relayed a description of Solis by radio to other officers, who found the accused shooter a few blocks away by an elementary school.

When police caught up to Solis, he had one handgun on him, but tossed the weapon. Police later recovered another firearm from near where Solis shot Brewster, according to the court documents, which also state that the entire incident was captured on Brewster’s body camera.

Solis later told investigators he knew that Brewster was police officer and had shot him to avoid arrest, and described Brewster as “non-threatening, did not have his weapon drawn, and was waving both hands when he shot him.”

Court records show that after police read Solis his “Miranda warnings” — the warning that one has the right not to speak or incriminate themselves — he told officers he should have shot his girlfriend instead.

Solis had a lengthy criminal record, including having been convicted of assault to a family member in 2015, evading arrest in 2016, and burglary of a vehicle in 2017.
