He was interviewed by detectives with the Dallas Police Homicide Unit and admitted to his involvement in the murder. He was transported to Lew Sterrett Jail and charged with capital murder, a capital felony.

Before the police arrived, a civilian on the scene saw what had occurred and fired his licensed handgun at O’Sullivan, striking him once in the shoulder, according to the police. The police Saturday did not identify the civilian.

The police said O’Sullivan pointed the handgun at officers as he ignored numerous commands to drop the weapon. Police used a Taser, but that was ineffective and had to physically subdue O’Sullivan to take him into custody.

O’Sullivan was arraigned Saturday at Westchester Medical Center, where he was taken for treatment. His next court date is scheduled for Feb. 12 in Haverstraw Village Justice Court, according to the Rockland County District Attorney's office.

"Our prayers go out to the family of the victim, Noe Hamer, who was gunned down in this senseless act of violence," District Attorney Thomas E. Walsh said in a statement.
