Lawsuit: Baldwin had no reason to fire in 'Rust' shooting

Lawsuit: Baldwin had no reason to fire in 'Rust' shooting LOS ANGELES (AP) — A lawsuit filed Wednesday alleges that Alec Baldwin recklessly fired a gun when it wasn't called for in the script when he shot and killed cinematographer Halyna Hutchins and injured director Joel Souza on the New Mexico set of the film “Rust.” “There was nothing in the script about the gun being discharged by DEFENDANT BALDWIN or by any other person," the lawsuit from script supervisor Mamie Mitchell says. The lawsuit is the second to stem from the shooting, with many more expected.

Derr, a concealed weapons permit holder, fired multiple rounds, striking Morales, according to police. Morales was still breathing after the shooting and was transported to Halifax hospital. However, she succumbed to her injuries and was pronounced dead shortly after arriving.

Before shots were fired, Morales yelled at the people who were outside her home that they were "three men" and "you followed me," according to a 911 call WESH published. Several shots are then heard being fired and the 911 operator asked, "What's that?"

The caller told the 911 operator that "a lady is shot" and that the "dude that got hit on the bike" was the one who shot her. When asked why he shot her, the caller said, "because she pulled a gun out on him."

Morales' handgun was recovered on the scene and Derr remained there until police arrived. Police said he's been cooperating with law enforcement "from the beginning" and no one has been charged.

Orange City Police Department Lieutenant Jason Sampsell told Newsweek the investigation was still ongoing, but said he anticipated Derr won't be charged with any crime.

The hit and run occurred around 5 p.m. on Saturday and police described it as a "minor crash." Derr was not injured or ejected from his motorcycle, according to the police department.

The Orange City Police Department is working in conjunction with the States Attorney's Office to continue investigating the incident, according to Orange City police.

Morales' family told WOFL she was four- or five-months pregnant when she was fatally shot and that she leaves behind an 11-year-old daughter and a fiance. Derr reportedly told WOFL that he hasn't been able to sleep since the shooting occurred and that he feels terrible for Morales' family, but that he felt he had "no other choice" but to shoot her.

A police report obtained by Newsweek said Derr told officers that he believed Morales was going to "shoot him and that he was going to die."

Jury to begin deliberations at Kyle Rittenhouse murder trial .
KENOSHA, Wis. (AP) — Jurors will begin deliberations Tuesday at Kyle Rittenhouse's murder trial after two weeks of testimony in which prosecutors and defense attorneys painted starkly different pictures of his actions the night he shot three men on the streets of Kenosha. Prosecutors claimed in closing arguments Monday that Rittenhouse was a “wannabe soldier” who provoked bloodshed by bringing a semi-automatic rifle to a protest and menacing others, then walking off like a “hero in a Western” after killing two men and wounding a third. © Provided by Associated Press A lone protester stands outside the Kenosha County Courthouse, late Monday, Nov.
