State District Judge Frank J. Castro dismissed the murder with malice charge against Pete Ortiz Jr., 75, on Monday. Ortiz surrendered Sept. 13 in the 399th state District Court in the death of Joe Ovalle, 26, who was shot to death in his garage in the 300 block of East Carson on Dec. 22, 1962.

Court records indicate the case was dismissed because “numerous and necessary material witnesses are deceased.”
