Lawyers for Ward have filed an opposition to Dugan’s request to release $100,000 from the court-controlled account, arguing that Dugan failed to provide “any factual basis in support of the requested amount which would clearly deplete a major portion of the assests of this Estate.”

A judge hasn’t ruled on Dugan’s request. The parties returned to court Thursday for a hearing in the civil action and have a telephone status conference scheduled for June 18, records show.

The Boston Herald first reported on the dispute over the funds.

It stems from a $5 million attachment that the court placed in December 2013, at Ward’s request, on any future sale of Hernandez’s home and other assets.

In January, after-tax proceeds of roughly $735,000 from the sale of Hernandez’s North Attleborough home were transferred to the court, according to legal filings.

Also in January, Shayanna Jenkins Hernandez, the mother of Hernandez’s daughter, filed a document called a right of homestead asserting that her child is entitled to $500,000 from the sale. The Bristol Probate and Family Court ordered that $500,000 be held in escrow until that claim is resolved.

Dugan said in the March filing that Hernandez’s estate had a current balance of just over $6,400 in its bank account, and that he had filed a $1 million corporate surety bond “to secure any loss of estate funds.”

“It is therefore necessary and proper for that this court release the sum of $100,000 to [Dugan], to be expended under the jurisdiction and oversight of the Probate and Family Court,” Dugan wrote.

He said he continues to “conduct research into any accounts, assets and/or claims that the Estate may have, deal with the Internal Revenue Service and Department of Revenue regarding past-due income taxes, file a Massachusetts estate tax return and communicate with counsel for the claimants and interested parties.”

In addition to Ward’s wrongful death suit, Hernandez’s estate faces wrongful death suits from the families of Daniel de Abreu and Safiro Furtado, two men Hernandez was charged with killing in a drive-by shooting in Boston in 2012.

Hernandez was acquitted of their murders in a criminal trial in 2015, days before his suicide.
