The American Civil Liberties Union has filed an official complaint against Kentucky's latest potential abortion ban. House Bill 5 is awaiting Governor Matt Bevin's signature.

The bill bans abortion based on the sex, race or disability of the fetus.

Kentucky has seen this battle before. In fact, Thursday's court filing is the latest in a series of litigation efforts between the ACLU and the Commonwealth, fighting over abortion.

The American Civil Liberties Union filed a legal challenge to the bill on the same day Bevin signed The ACLU , which sued on behalf of Kentucky ’ s sole abortion clinic, EMW Women’s Center in The General Assembly also passed a bill in January that banned women from getting an abortion after

The American Civil Liberties Union is suing Kentucky over a recently passed law that bans an abortion procedure which involves ripping apart a human fetus and then removing the pieces one at a time from a The lawsuit claimed in part that the ban on the procedure prevents late -term abortions .

"They've been absolutely relentless in their attack's on abortion and access, and we have been just as relentless in our commitment to protecting access in the state," said Amber Duke, Communications Director for ACLU of Kentucky. "They all come from the same anti-abortion playbook and they're really just using the language of anti-discrimination, the language of human rights to dress-up what is simply an abortion ban."

Sponsors said the the bill extends civil rights to the unborn child. They point to a study showing between 70 and 90 percent of fetuses diagnosed with Down Syndrome are aborted.

But ACLU members says they've supported several anti-discrimination bills throughout the years that never get through the legislative session.

The ACLU has requested a restraining order or preliminary injunction once the governor signs the bill into law.

Regarding the court challenge, Governor Bevin tweeted "bring it."
