Dozens of high school and college students rallied at Hillview Park in San Jose on Tuesday as the Supreme Court took up a landmark case that will determine the future of the Deferred Action for Childhood Arrivals program.

The high court heard oral arguments Tuesday morning and will determine whether President Trump had the authority to end DACA in September 2017. The program gave more than 700,000 young undocumented immigrants deportation relief and work permits, allowing them to pursue higher education and professional careers.

“I’m here to represent my story and the story of others,” said Yasmin Gomez, 21, a DACA recipient from San Jose. “Not only our stories, but the stories of our parents. Our parents made this possible for us. We’re here because of them.”

At 16, Gomez was pregnant. DACA allowed her to work to support her daughter, Delilah, she said.

She expects to graduate from Menlo College in December with a bachelor’s degree in marketing and will start a full-time job with a nonprofit.

The case resulted from a petition to the Supreme Court by William Marbury, who had been appointed by President John Adams as Justice of the Peace in the District of Columbia but whose commission was not subsequently delivered. Marbury petitioned the Supreme Court to force the new Secretary of

“We’re not criminals. We’re not doing anything other than trying to get our jobs and get our school done and trying to support our families,” she said. “It’s what any other American does.”

Justices appeared split on the issue Tuesday, with the five conservative justices showing skepticism toward arguments that President Trump did not give sufficient reason for rescinding the program in 2017.

The four liberal justices questioned whether the Trump administration considered that entire families, businesses, schools and other institutions would be affected by the program’s repeal.

Trump said Tuesday that many DACA recipients are “no longer very young” and are “far from angels.”

“President Obama said he had no legal right to sign order, but would anyway. If Supreme Court remedies with overturn, a deal will be made with Dems for them to stay!” he tweeted.

Carlos Navarro, 73, a retired Mexican American studies professor, came to the rally from Castro Valley.

“Many of them were brought here as toddlers,” he said of the DACA immigrants, many of whom were his students. “They know nothing else besides California and San Jose. The idea that they could be deported to what is, for them, a foreign country is immoral and just wrong.”

Advocates also demonstrated in Half Moon Bay and at the University of San Francisco, where educators held a prayer vigil.

“We’re humans and we’ve been here and raised as Americans as much as the people who are in the Supreme Court hearing and arguing these cases,” said Dioscelenne Tlatenchi Guzman, a junior.

The Supreme Court is expected to rule by June.
